Incident in bar leads to felony count for ex-convict

OTTAWA — A La Salle man once imprisoned for his role in a fatal bar fight was indicted Tuesday for his role in a Dec. 16 fight in La Salle.

A La Salle County grand jury convened Tuesday and indicted Bryan R. Tomaseski, 28, of 1596 Linden Ave. on one count of aggravated battery, a Class 3 felony carrying 2-5 years in prison.

Tomaseski turned himself in March 12 on a La Salle County warrant issued following a lengthy investigation into a Dec. 16 fight at Jake’s Pour House in La Salle, where the victim reportedly sustained only minor injuries.

The charge is a felony because it occurred in a public place and because Tomaseski was previously convicted, and imprisoned, for manslaughter. He served 3 years in prison for the 2007 killing of 25-year-old Andrew Sibley outside a La Salle tavern.

Tomaseski completed his prison time and was not on parole at the time of the Dec. 16 fight in La Salle. He is free on bond and will appear Thursday for arraignment before Associate Judge Daniel J. Bute.

Separately, an Ottawa High School honors graduate was indicted on three counts of aggravated battery.

Nathan Hawk, 18, of 115 Watson Ave., Ottawa is being held on $1 million bond while awaiting trial on charges stemming from a March 15 battery in his home.
Ottawa police responded to a 911 call and located a 50-year-old female who suffered serious trauma. Hawk allegedly fought with the arriving officers and had to be subdued.

He faces 2-5 years on the count for the 50-year-old’s injuries and 3-7 years for the two counts related to the batteries to police.

Also indicted Tuesday were: Robin R. Girard, 41, of Ottawa (two counts of theft); Jacob P. Theurer, 18, of Earlville (residential burglary); Misty D. Donovan, 21, of Earlville (new count: residential burglary); Lynnard F. Farley, 20, of Earlville (new counts: residential burglary, burglary); Tony W. Hughes, 21, of Earlville (two counts of residential burglary, arson); Ernest Clark, 29, of Chicago (unlawful possession of a controlled substance with intent to deliver); Frank E. Sirtoff, 52, of Ottawa (aggravated battery); Richard F. Graham, 52, of Ottawa (driving while revoked); Jerome G. Shorkey, 31, of Ottawa (retail theft); Joseph J. Stash, 31, of Streator (forgery); Ashley Harlacher, 23, of Streator (forgery); Thomas M. Wagner, 19, of Streator (aggravated battery); Joel Molina, 21, of La Salle (new counts: driving while revoked, driving under the influence); Alicia Douglas, 47, of Spring Valley (retail theft); Melanie G. Thompson, 29, of Peru (unlawful possession of cannabis with intent to deliver); Juan Reyes, 50, of Miami, Fla. (new count: cannabis trafficking); Matthew P. Flynn, 22, of Acton, Mass. (unlawful possession of cannabis with intent to deliver); Sameer A. Issa, 22, of Nashua, N.H. (unlawful possession of cannabis with intent to deliver).
