Doctor removes kidney instead of piece of spleen

A Mendota woman recently settled a medical malpractice case for $2 million.

Dana Ladson had sued a Peoria physician in 2007 in Peoria County Circuit Court after the doctor removed a healthy kidney instead of the remnant of her spleen, which had been surgically removed to treat a blood disorder.

Ladson had suffered from a blood-clotting disorder resulting in a low level of platelets. Treatment options included removing the spleen to stabilize the condition. When in 2005 Ladson’s condition again deteriorated, Dr. Gavish N. Patel recommended removal of the remnant of her spleen but instead removed a healthy kidney.

Patel and his insurers settled the lawsuit shortly before trial.

Ladson was represented by Peru attorney Anthony C. Raccuglia, who said the settlement amount may seem high but does not replace the loss of a good kidney.

Patel’s attorney, Greg Cerulo of Peoria, was not in his office Friday and a voice message left for him was not returned before press time.
